These Terms & Conditions ("Terms") govern your use of Messages: SMS Text Messenger (the "App"), published by Amazun Apps ("Amazun," "we," "us," "our"). By downloading, installing, or opening the App, you agree to be bound by these Terms. If you do not accept them, please do not use the App.
1) What the App Is
Messages: SMS Text Messenger is a mobile messaging application that lets you send and receive SMS and MMS text messages, view and manage conversation threads, share media attachments, and customize notification and interface settings.
2) Who May Use the App
You may use the App only if you meet the minimum age required to use text messaging services in your jurisdiction, and — if you are considered a minor under local law — you have the permission of a parent or legal guardian. You agree to use the App solely for lawful purposes.
3) Permissions the App Uses
The App may request access to the following device features:
- SMS/MMS messaging, to send, receive, and display your texts;
- Contacts, to identify senders and recipients by name;
- Camera and media library, to attach and view photos, videos, or files;
- Storage, to save attachments and optional local backups;
- Notifications, to alert you of new messages.
You may disable any of these permissions through your device settings at any time. Some features of the App may not function correctly if you do.
4) Rules for Using the App
You agree that you will not use the App to:
- send spam, mass unsolicited messages, or fraudulent communications;
- harass, threaten, defame, or impersonate any person or organization;
- distribute content that is unlawful, obscene, or infringes on the rights of others;
- interfere with, hack, or attempt to disrupt the App or its systems;
- violate any telecommunications, data protection, or consumer protection law applicable to you.
We may suspend or restrict your access to the App if you violate this section.
5) Ownership of Your Messages
You retain full ownership of any messages, photos, or files you send or receive through the App. Amazun Apps does not claim ownership of, and does not routinely access, the content of your personal conversations. If the App offers optional backup or sync features, their use is subject to your consent and is described in our separate Privacy Policy.
6) Carrier Charges and Network Reliability
The App depends on your device's SIM card and cellular or data connection. Standard SMS, MMS, or data charges from your mobile carrier may apply. Amazun Apps is not responsible for carrier fees, roaming charges, or message delivery delays caused by network conditions beyond our control.
7) Intellectual Property
The App's source code, design, trademarks, and branding are the property of Amazun Apps or its licensors. You are granted a limited, personal, non-transferable, and revocable license to use the App. You may not copy, modify, reverse-engineer, resell, redistribute, or use our branding without our prior written consent.
8) Third-Party Services
The App may integrate with third-party services, such as cloud backup providers, sticker packs, or analytics tools. These services are governed by their own separate terms and privacy practices, which Amazun Apps does not control and is not responsible for.
9) Privacy
Our data collection and handling practices are described in our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the practices described there.
10) Updates and Availability
Amazun Apps may release updates, add or remove features, or temporarily suspend the App for maintenance, at its discretion and without prior notice. We do not guarantee that the App will be available at all times without interruption.
11) Suspension and Termination
We may suspend or terminate your access to the App at any time, without prior notice, if we determine, in good faith, that you have violated these Terms or engaged in conduct harmful to other users or to Amazun Apps.
12) Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by applicable law.
13) Limitation of Liability
To the extent permitted by law, Amazun Apps shall not be liable for any indirect, incidental, special, or consequential damages — including loss of messages, data, or profits — arising from or related to your use of the App. This limitation does not apply to liability that cannot be lawfully excluded, such as for death, personal injury, or fraud.
14) Changes to These Terms
We may revise these Terms periodically to reflect changes in our practices, features, or legal requirements. Material changes will be communicated through the App or its store listing. Continued use of the App after such changes take effect constitutes your acceptance of the revised Terms.
15) Governing Law
These Terms are governed by the laws applicable to Amazun Apps' principal place of business, without regard to conflict-of-law principles.
